1. Acceptance of Terms

By accessing or using this website (valleyserveco.com), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, please do not use this site.

2. Service Description

Valley Serve Co. provides professional process serving throughout Skagit County and surrounding areas. Services include delivery of legal documents, documentation of service, and related administrative tasks. Valley Serve Co. is not a law firm and does not provide legal advice.

3. Client Responsibilities

Clients are responsible for:

• Providing complete and accurate documents and service details

• Confirming service addresses are valid and up to date

• Complying with all court filing deadlines independent of Valley Serve Co.’s delivery date

Inaccessibility includes, but is not limited to: locked or obstructed gates, aggressive animals, lack of safe parking or entry, refusal of entry by residents or staff, unsafe conditions, or the subject being visibly present but unwilling to engage.

Valley Serve Co. reserves the right to charge an additional fee for reattempts due to inaccessibility, and any additional fees incurred during such a scenario will always be assessed with the client before the fee is due.

4. Payments

Once a service request is received and confirmed, Valley Serve Co. will provide a detailed invoice outlining the cost and scope of the job. Service will not begin until payment is received in full, unless otherwise agreed in writing.

This policy ensures clarity, fairness, and avoids billing disputes. If a job is canceled before an attempt is made, a full refund may be issued. No refunds will be given once an attempt has been made, regardless of the outcome.

5. Declaration of Service

Upon successful service, a signed Declaration of Service will be provided.

If service is not completed:

• All attempts will be documented in writing

• After three unsuccessful attempts, or upon confirmation that the subject no longer resides at the provided address, Valley Serve Co. will issue a Declaration of Non-Service outlining the details and reason for non-completion

All declarations are executed truthfully and under penalty of perjury in the State of Washington.

Handling of Documents After Unsuccessful Service

If service is not completed, all original documents received from the client will be:

• Returned promptly, either digitally or by mail (as agreed)

• Retained temporarily in secure storage until returned or until the case is closed

• Handled with strict confidentiality and never shared or discarded without client direction

Clients may also request destruction of unserved documents in writing.

6. Document Uploads

Uploaded documents are used solely for service of process. All uploaded files are handled confidentially and not shared with third parties outside of legal necessity.

7. Limitation of Liability

Valley Serve Co. is not responsible for:

• Court deadlines missed due to external delays (weather, inaccessibility, subject evasion, etc.)

• Legal outcomes related to the served matter

• Client misuse of service documentation

Maximum liability for any claim shall not exceed the amount paid for the specific job in question.

8. Copyright & Trademarks

All content, branding, and visuals (including the Valley Serve Co. logo) are the intellectual property of Colten Rocha and may not be reproduced without written permission.

9. Changes to Terms

Valley Serve Co. reserves the right to update these Terms of Service at any time. Updates will be posted on this page with an effective date. Continued use of the website after changes constitutes acceptance of the new terms.
